BOOKING CONDITIONS & INSURANCE DETAILS

Booking Terms & Conditions - Your contract with EAGLE GOLF TOURS LIMITED

1. BOOKING YOUR HOLIDAY
When your deposit and insurance monies (if required) are received we will send a Confirmation Invoice showing the date balance of payment is due. At this point a Contract has been made between us. Your booking has been accepted, subject to the Terms and Conditions set out below.

2. BALANCE
Payment of balance is due not less than 60 days before departure date. Should payment not be received by this date we reserve the right to cancel your booking and you will be liable for cancellation charges up to 100% of the final invoice total, in accordance with Clause 4. Where bookings are made within 60 days of departure date full payment should be made at the time of booking.

3. BOOKING CHANGED BY YOU
If you, or any member of your party, wish to change any part of your reservation more than 60 days prior to departure date, a charge of £15 per booking will be made. If request to change is received less than 60 days prior to departure, we will do our utmost to help, although we reserve the right to enforce cancellation charges as detailed.

4. CANCELLATION BY YOU

If you, or any member of your party, wish to cancel after confirmation of booking is made, more than 60 days prior to departure date only the loss of deposit plus insurance is incurred. Cancellations must be made in writing and the date of receipt of your letter will be deemed to be the date of cancellation. Where cancellation is made within 60 days of departure date the following charges will be incurred:
60-45 days 30%, 44-15 days 60%, 14-0 days 100%.

5. NAME CHANGES ON RESERVATIONS
Airlines do not allow name changes on your flight reservations therefore, if you wish to change a name on your reservation, it will be subject to flight availability and cost on the date you notify us. If this is within 60 days of departure the person cancelling will lose their deposit. The new person will pay the full price of the holiday plus any additional flight costs incurred. If the size of the group changes prior to travelling we reserve the right to recalculate the costs for the remaining members of the group and levy any additional charges which may be due.

6. REFUNDS ON CAR HIRE, ACCOMMODATION, FLIGHTS AND GREEN FEES
Please also note that any refunds on car hire, hotel, green fees etc. will only be made at our discretion and irrespective of what you may be told locally. Please read all the information we send you as these documents include important information.

7. CUSTOMER SERVICE AND COMPLAINTS
If you have a problem during your holiday, it is imperative that the local representative or our office in the UK be advised immediately. They will then endeavour to rectify it. In the unlikely event that the matter cannot be resolved at the resort, you must contact us in writing within 28 days of returning to the UK, quoting your booking reference and any other relevant information to support your claim. We will not accept liability in respect of claims received after 28 days.

8. TRAVEL INSURANCE
It is a condition of booking that you accept our travel insurance or, alternatively, arrange adequate insurance cover yourself.

9. OUR PRICE GUARANTEE

The prices quoted in our confirmation details are based on costs and exchange rates as at that time. Provided that all our booking conditions have been complied with, Eagle Golf Tours guarantees that no surcharges will be imposed due to changes in resort costs relating to your holiday. However, we reserve the right to pass on any increase in costs due to exchange rate variations, fuel prices or other charges that affect aviation costs from those existing at the date on which the holiday price is agreed, based as given above up to a limit of 10% per person. Should the price fluctuate above 10% you have the right to cancel without penalty.

10. IF WE CHANGE YOUR RESERVATION

a. Most changes are of a minor nature and we will advise you at the earliest possible date.
b. We reserve the right to make a major change if necessary. We will notify you as soon as possible and offer alternative arrangements and compensation where applicable, as stated below. A major change is any of the following changes made before the day of departure. Change of airport, resort, outward or return time of departure by more than 12 hours or substitution of the accommodation you have booked with one of a lower classification. You then have the choice of accepting our alternative arrangements, together with the offered compensation, or cancelling, in which case a full refund of all monies paid will be available. Notifications of your acceptance or refusal of the alternative arrangements must be received by us in writing within 3 days of our notice of the change to you. Compensation per person for major changes more than: 60 days - Nil, 29-59 days - £10, 15-28 days - £20, 0-14 days - £30.
c. Occasionally it is necessary to amend golfing arrangements or cancel tournaments if the minimum number of entrants is not achieved. Eagle Golf Tours reserve the right to do this. Amendments will be advised and alternative arrangements offered wherever possible.

11. IMPORTANT NOTICE - IF WE CANCEL YOUR RESERVATIONS

Due to operational problems, it may become necessary for us to cancel your reservation totally. We will do our utmost to avoid such a situation, but should it arise, we will offer you alternative arrangements, an allowance of £20 per person off another holiday of your choice from the Eagle Golf Tours brochure, or a full refund of all monies paid to ourselves. We will not cancel your holiday within the period of 8 weeks prior to your departure, unless the cancellation is caused by the occurrence of events beyond our control. Where compensation payments are accepted for major changes or cancellation, Eagle Golf Tours will not be liable for any other claim for compensation or expenses. The above compensation payments are not applicable if the change is due to events covered under section 14 (Force Majeure).

12. CONDITIONS OF TRAVEL

In respect of carriage, the conditions of the Airline and Coach companies apply, some of which may limit or exclude liability. These conditions are subject to Government rulings and, in the case of an Airline, the conditions of carriage are laid down by the Warsaw Convention of the 12 October 1929, or as amended at the Hague, 28 September 1955. Full details of same are clearly stated on your Airline Tickets, and details are available on request.

13. JURISDICTION

This contract between any client and ourselves shall be subject to English Law.

14. OUR LIABILITY TO YOU

Eagle Golf Tours only accept responsibility in respect of holiday arrangements made which are wholly within our control. Eagle Golf Tours can accept no liability whatsoever in respect of action taken by employees or Agents of any establishment or service. Please note, all your holiday arrangements are subject to the conditions of the relevant supplier, some of which exclude the suppliers' liability to you. You are deemed to have accepted these conditions, which can be obtained from ourselves or suppliers on request.

15. FORCE MAJEURE

It is regrettable that we cannot accept liability or pay compensation where we are forced to delay, curtail, cancel or in any way alter your holiday, or where the prompt performance of our contractual obligations is affected in any way, as a result of events amounting to force majeure. These include war, or threat of, civil strife, riot, terrorist activity, industrial disputes, epidemics, health risk, fire or adverse weather conditions, technical problems with transport closure or congestion of airports, changes and cancellations by airlines, government action and any circumstances outside our control, also including natural or nuclear disaster.


INSURANCE
We strongly recommend that you and all members of your party be adequately insured as soon as you book your holiday. Indeed it is a condition of booking that you must have insurance cover at least equivalent to that described below. We have arranged a special scheme with Travel & General Insurance Services Limited, underwritten by Travel & Personal Underwriters Limited who are Underwriting Agents on behalf of Royal and Sun Alliance Group Plc, Gouda International and ACE Insurance SA-NV.

Below is a summary of cover and benefits available under the insurance. An insurance certificate containing a more detailed summary will be sent to you with your confirmation of booking. In any event you may ask for a specimen copy of the insurance wording should you wish to examine this in advance.
The insurance will be subject to English law unless otherwise agreed.

The above premiums are inclusive of 17.5% Insurance Premium Tax that is adjustable on any amendment to that tax or its rate.

Claims
Should you need to make a claim, please contact our loss adjusters detailed below and request a claim form. In all correspondence please quote that your insurance is with Eagle Golf Tours -

All claims must be submitted within 31 days upon arrival back in the United Kingdom

IMPORTANT NOTICE
Your (travel) insurers, under the Association of British Insurers General Business Code of Practice, have to bring to your attention some of the important features of your insurance policy, including:

Health Conditions:
Whilst the Insurance is not subject to a health warranty, Underwriting Agents shall not be liable for claims WHERE AT THE TIME OF TAKING OUT THIS INSURANCE:

1. The Insured Person is aware of any medical condition or set of circumstances which could reasonably be expected to give rise to a claim, or

2. Any person, including those not travelling,
i) has during the twelve months prior to taking out this
insurance suffered from any chronic and/or recurring
illness of a serious nature which has necessitated
consultation or treatment or has been referred for
further investigations UNLESS DECLARED TO AND
ACCEPTED BY THE UNDERWRITING AGENTS
BY RINGING 0800 281488 (9.00 a.m. to 5.30 p.m.
Monday to Saturday)
ii) is suffering from or has suffered from any diagnosed
psychiatric disorder, anxiety or depression; or
iii) is recovering, or on a waiting list for treatment in a
hospital or nursing home; or
iv) is expected to give birth before or within 14 weeks
of the date of arrival home; or
v) is travelling against the advice of a Medical
Practitioner or for the purpose of obtaining medical
treatment abroad, or
vi) has been given a terminal prognosis

Policy Document: this gives you full details of what is and is not covered and the conditions of cover. You must read the insurance policy carefully.
Conditions, Exclusions and Warranties: conditions and exclusions will apply to the individual sections of your policy while general exclusions, conditions and warranties will apply to the whole policy.
Property Claims: these claims are paid based on the value of the goods at the time you lose them and not on a 'new for old' or replacement cost basis. Your policy will set out what proof the insurer needs to support a claim.
Date Recognition Failure: Your policy contains exclusions for losses arising from failure to correctly recognise the calendar date, such as the change to the year 2000.
Policy Limits: most sections of the policy have limits on the amount the insurers will pay under that section. Some sections also include other specific limits, for example, for any one item or for valuables in total. You are advised to check your policy if you intend taking expensive items with you.
Policy Excesses: under most sections of the policy claims will be subject to an excess. This means that you will be responsible for paying the first part of each claim. The amount you have to pay is the excess.
Reasonable Care: you need to take all reasonable care to protect yourself and your property, as you would if you were not insured.
Complaints: the insurance policy includes a Complaints Procedure which tells you what steps you can take if you wish to make a complaint.
Fraud: it is a criminal offence to make a fraudulent claim.
Dangerous Sports or Pastimes: if you are going to take part in dangerous sports or pastimes where there is a risk of injury, check that your policy covers you.
Cooling Off Period: Your insurance certificate contains a "cooling off" period of 14 days during which you can return the insurance document and get a refund if you have a justifiable reason for being dissatisfied with the cover it provides The Insurance Policy will be subject to English Law unless agreed otherwise.
